Governing Law
These Terms shall be governed by and interpreted in accordance with the laws of Germany.
Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Germany.

In these Terms and Conditions, the following terms have the meanings listed below:

"Creator" refers to a user who uploads content to the website that can be viewed by other users.
"Fan" refers to a person who follows a Creator and views the Creator’s content.
"You/User" refers to all users, whether Creator or Fan.
"Seller" refers to all age-verified Creators.
"Buyer" refers to all users, whether Creator or Fan.
"Content" refers to all material uploaded by a user (whether Creator or Fan) on 4secretfans, including photos, videos, audio, live-stream material, data, text (e.g., comments), and any other material.
"4secretfans" refers to the social network of users operated on the website, enabling users to provide and view content where applicable.
"Payment Provider" refers to a third-party provider approved by 4secretfans that enables a user to make payments or a Creator to receive payments.
"User Account" refers to the section of the website that is accessible only by 4secretfans or the respective user and contains the user’s payment information.
"User Content" refers to all photos, videos, and other materials or facilities uploaded by a Creator to the website.
"Website" refers to the website at www.4secretfans.com.
"The Provider" refers to the website www.4secretfans.com.

Scope

These Terms & Conditions govern:

the use of the platform for custom, adult, and fetish-oriented content by Creators and Fans;
the general terms governing the use of the website;
licensing provisions and intellectual property rights;
the rules governing links and hyperlinks;
the limitation of liability; and
the Privacy Policy.

1. Acceptance of These Terms

This document, together with our rules, policies, and any other documents referenced herein, constitutes our Terms & Conditions ("Terms"). These Terms govern your rights and obligations when registering for and using 4secretfans.

If you do not agree to these Terms or fail to comply with their provisions, you must not use 4secretfans.

4secretfans will update these Terms where necessary due to legal requirements, technical changes, changes to the services offered, or operational requirements.

The most current version of these Terms will always be available on the website. Any amendments will not apply to disputes that arose before the amendments became effective.

In the event of material changes, 4secretfans will notify users through appropriate communication channels, including via the service or by email.

Your continued use of 4secretfans after the updated Terms become effective constitutes your acceptance of the revised Terms. If you do not agree to the changes, you must stop using 4secretfans.

Any amendments to these Terms will become effective upon publication unless applicable law requires an earlier effective date. A change will be considered material if it significantly affects the rights or obligations of users.

By continuing to use the 4secretfans platform and, where applicable, by accepting payments, Creators and Users acknowledge that they have read, understood, and agreed to these Terms.

BY USING OUR SERVICE, YOU ENTER INTO A LEGALLY BINDING AGREEMENT AND AGREE TO COMPLY WITH THESE TERMS.

2. License

2.1 Grant of License

4secretfans hereby grants you a non-exclusive, non-transferable, and non-sublicensable license to access the Website and its content in accordance with these Terms & Conditions solely for your personal and non-commercial use.

For the purposes of these Terms & Conditions, "access" means visiting the Website, using its services, and viewing or downloading content to the extent permitted under these Terms & Conditions. "Content" includes text, software, scripts, graphics, photographs, audio files, music, videos, audiovisual content, interactive features, and any other materials made available on the Website.

Creators retain all rights to their content. By uploading their content, they grant the Platform a non-exclusive, revocable license solely for the purpose of storing, making available, processing, moderating, reviewing, and distributing the content on the Platform.

Only Creators whose identity has been successfully verified may publish or monetize content on the Platform. Verification is mandatory and is a prerequisite for publishing and selling content.

Creators may continue to use, reproduce, and publish their content on other platforms. The Platform does not obtain any further rights of use, in particular no right to use the content for its own advertising purposes without the Creator's express consent.

2.2 License Restrictions

The license granted in Section 2.1 does not include, in particular:

the resale or commercial use of the Website;
the distribution, public performance, or public display of the Website or its content;
the modification of or creation of derivative works based on the Website or its content, unless 4secretfans has given its prior express written consent;
the use of robots, scraping, data mining, or similar automated collection or extraction methods;
the downloading of content except where expressly provided on the Website;
any other use of the Website or its content outside its intended purpose.

The license to access the Website does not transfer any ownership or other rights in the content. Downloaded or printed content may only be used in accordance with these Terms & Conditions. Copyright notices and other proprietary notices may not be removed or modified.

Any use of the Website or its content outside the rights granted under these Terms & Conditions automatically terminates the license granted and may violate applicable law as well as intellectual property rights.

2.3 Termination of the License and Removal of Content

The license automatically terminates as soon as a Creator deletes their account or removes the relevant content.

The Platform will delete the relevant content within a reasonable period of time, unless statutory retention obligations, governmental orders, or other binding legal obligations prevent such deletion.

3. Intellectual Property Rights of 4secretfans

3.1 Ownership of the Website

Unless otherwise stated in this Agreement or on the Website, 4secretfans owns or has a license to use:

the Website, including its past, present, and future versions;
all webpages within the Website;
all materials and information on the Website;
all graphics, text, images, audio files, videos, designs, compilations, advertising copy, articles, user interfaces, illustrations, software applications, copyrighted content (including source code and object code), and all other materials, including the design, structure, "look and feel," and arrangement of the content on the Website;
all trade names, trademarks, service marks, logos, domain names, and other distinctive brand elements contained on the Website, whether registered or unregistered.

Intellectual property rights, including copyrights, patents, service marks, trademarks, trade dress, trade secrets, international treaties, and various other laws protecting intellectual property and against unfair competition, protect the Website and its content. When using the Website or its content, all applicable intellectual property rights as well as any specific notices displayed on the Website must be observed.

3.2 Trademarks

The name, logos, domain names, and the term "4secretfans" are protected trademarks of 4secretfans and may not be copied, imitated, or used, in whole or in part, without the prior written consent of 4secretfans.

In addition, page headers, custom graphics, button icons, and scripts are protected trademarks or protected design elements of 4secretfans and may not be used without prior written consent.

Other companies, products, or services mentioned on the Website may be trademarks of their respective owners. The mention of such trademarks does not constitute any sponsorship, endorsement, or affiliation with 4secretfans.

Without express permission, you may not:

republish, sell, rent, or sublicense material from 4secretfans.com, unless it is your own content;
reproduce, duplicate, or copy material from 4secretfans.com without authorization;
redistribute content from 4secretfans.com unless it consists of your own uploaded content.

The Platform removes content that violates applicable laws, the rights of third parties, or the Platform Policies.

4. Registration and Account Management

4.1 Fans

To register an account as a Fan on 4secretfans, you must provide a valid email address, username, and password. If you wish to purchase content or subscribe to Creators, you must provide a valid payment method. 4secretfans does not store payment information.

4.2 Content Providers / Creators

Definition

For the purposes of these Terms & Conditions, the terms "Creator" and "Content Provider" refer to users who register directly on the Platform and upload, manage, publish, or distribute their own content through their accounts.

4secretfans does not permit unauthorized third-party agencies, aggregators, or intermediaries to upload content on behalf of other individuals without proper authorization and compliance verification.

Creators

You must complete the registration process by providing 4secretfans with complete, accurate, and up-to-date information.

Registration as a Creator is carried out following verification of the requirements set out in these Terms & Conditions. If you wish to sell content on 4secretfans, you must verify that you are of legal age (at least 18 years old) by providing a valid government-issued identification document and linking a verified bank account or one of the available payout methods.

In addition, as a Creator, you agree that you possess all necessary work rights in your country of residence. This includes, in particular, valid work permits or visas where legally required. You are responsible for ensuring that you meet all legal requirements for using 4secretfans, including tax obligations and obtaining any required tax identification numbers.

4secretfans regularly verifies compliance with these requirements and requests additional documents or information where necessary to comply with legal obligations, regulatory requirements, or to conduct compliance reviews. If the requirements for using the Platform as a Creator are not met, appropriate measures will be taken. These may include, in particular, restricting account functionality, removing content, or suspending or terminating the account. By continuing to use 4secretfans as a Creator, you confirm that you have read, understood, and accepted these terms regarding registration, verification, and compliance with employment and legal requirements.

4.3 User Confirmations

By registering and creating an account on 4secretfans, you confirm and warrant that:

all registration and profile information, as well as the content you provide, belongs to you and is complete, truthful, and accurate;
you are responsible for maintaining the confidentiality of your password and account;
you exercise special care when accessing your account from a public or shared computer to prevent unauthorized access to your account and personal data;
you are responsible for all activities that occur under your account;
you will immediately notify 4secretfans of any unauthorized use of your account or any security breach;
you will never use another person's account;
your previous account on 4secretfans has not been suspended or terminated due to a violation of this Agreement;
you create your account for your own personal use and will not sell, rent, or transfer it to any third party;
you have the right to grant the licenses set out in these Terms & Conditions and, if you use 4secretfans on behalf of a company or other legal entity, you have the authority to bind that company or legal entity to these Terms & Conditions.

4.4 Liability for Account Misuse

4secretfans is not liable for any losses you may suffer as a result of a third party using your account or password, whether with or without your knowledge. However, you may be held liable for losses incurred by 4secretfans or others due to the unauthorized use of your account or password.

4.5 Account Security

4secretfans places great importance on the security and integrity of your personal data.

4secretfans implements appropriate technical and organizational security measures to prevent unauthorized access, loss, or misuse of personal data. Complete security of digital systems cannot be guaranteed due to the technical nature of the Internet.

You acknowledge that you are responsible for the security of your login credentials and must carefully protect your personal data.

To further enhance the security of your account, the Platform offers two-factor authentication, which you can activate at any time in your account settings.

5. Content Review and Verification Policies

Statement Pursuant to 18 U.S.C. §2257 / Exemption

All content published on this Website:

either does not fall within the scope of 18 U.S.C. §2257 and 28 C.F.R. Part 75 because the content does not depict sexually explicit conduct specifically defined by law; or
is published by users, Creators, or Content Providers who confirm and ensure that all applicable legal requirements, particularly with regard to age verification, record-keeping obligations, and compliance requirements, are fulfilled.

All users, Creators, and Content Providers must be at least 18 years of age and verify their identity before they are permitted to publish content on the Platform.

All uploaded content is reviewed prior to publication and remains subject to ongoing moderation and active monitoring after publication. Active monitoring includes, in particular, the regular review of published content, the examination of reported content, the detection of violations of applicable legal requirements, and the verification of compliance with the Platform Policies. 4secretfans uses technical and manual review procedures to detect prohibited, illegal, abusive, exploitative, or non-consensual content and to take appropriate action.

The review process includes:

automated checks for problematic or non-compliant content;
manual review by trained moderators;
requesting required documentation, particularly where necessary for age verification, identity verification, or compliance with legal obligations.

Content that violates applicable laws, the rights of third parties, or the Platform Policies will be removed or made inaccessible to users.

Identity and Age Verification

Content Creators must complete an ID verification process to confirm their identity and ensure that they are of legal age. Regular users (Fans) must complete an age verification process to confirm that they are at least 18 years old.

Content Creators may only upload content in which they themselves appear. If other individuals appear in the content, Content Creators must:

verify the identity and age of all individuals depicted;
ensure that all individuals depicted are of legal age;
retain appropriate records of these verifications and provide them to the Platform upon request.

The Platform continuously monitors compliance with these requirements and takes action whenever content or user activity violates applicable laws or the Platform Policies.

6. User Conduct Rules

Users are prohibited from engaging in the following prohibited activities:

copying, distributing, or disclosing any part of the Website in any medium, including through automated or non-automated scraping;
using automated systems such as robots, spiders, or offline readers to access the Website;
transmitting spam, chain letters, or other unsolicited messages;
attempting to interfere with, impair, or compromise the integrity or security of the system or decrypt transmissions to or from the Website's servers;
engaging in actions that unreasonably or disproportionately burden the Website's infrastructure or interfere with its proper operation;
uploading or transmitting viruses, worms, malware, or other harmful code;
collecting, storing, or processing personal data of other users without their express consent;
using the Website for unauthorized commercial advertising or third-party advertising;
impersonating another person or falsely representing your identity, affiliation, or authority;
interfering with or disrupting the proper operation of the Website or the services provided through it.

If a user threatens, harasses, stalks, or bullies a Creator through the Platform or through a social media platform associated with the Creator, that user's access to the Creator's profile or content will be restricted or terminated.

Violations of this section or any other provision of these Terms & Conditions may result in removal from the Platform. A refund will only be provided where required by applicable law.

7. User Rights and Responsibilities

7.1 Copyright and Usage Rights

Creators retain all rights to the content they upload. By uploading their content, they grant 4secretfans a non-exclusive, transferable, sublicensable, royalty-free, and worldwide license to use the content solely for the operation, provision, display, storage, transmission, and technical processing within the Platform.

Any use of the content outside the Platform, in particular for advertising purposes, independent commercial exploitation, or in modified form, shall only take place with the express consent of the respective Creator or on the basis of a legal authorization.

This license serves exclusively for the operation and functionality of the Platform.

7.2 Responsibility for Uploaded Content

Each user confirms by uploading content that:

they possess the necessary rights, licenses, and permissions to publish the content;
no third-party rights are infringed;
the content complies with applicable laws and the Platform Policies.

4secretfans reviews uploaded content as part of its content review and moderation process. Content that violates applicable laws, third-party rights, or the Platform Policies will be removed or restricted.

7.3 Use and Protection of Creator and Fan Content

Creators warrant that they hold all rights to the content they upload.

Fans may use purchased content only within the scope of the granted usage rights. Reproducing, publishing, distributing, reselling, making the content publicly available, or otherwise sharing the content with third parties without the express consent of the respective rights holder is prohibited.

7.4 Comments and User Content

Users may publish comments and opinions in the areas of the Platform designated for this purpose.

All reported comments or comments identified through moderation are reviewed. Comments or content that violate applicable law, these Terms & Conditions, or the Platform Policies will be removed.

In particular, users may not publish content or comments that:

infringe the rights of third parties;
are abusive, discriminatory, defamatory, or libelous;
contain hate speech, violence, or unlawful content;
are used for unauthorized commercial purposes or unlawful activities;
violate applicable laws or the Platform Policies.

8. Payment Terms & Monetization

8.1 General Provisions Regarding Transactions

For payment processing, 4secretfans works with external payment service providers, including Verotel and CCBill, to securely process transactions made through the platform.

All financial transactions on 4secretfans are conducted between Fans and the 4secretfans Platform.
4secretfans facilitates payments, stores content, and acts as the contractual party in these transactions.
Creators make content available at their own discretion – 4secretfans has no influence over the type, quantity, or quality of the content provided.
Creators set their own prices. It is your responsibility to review the price before subscribing or making a purchase.
All payments are made through the Wallet, with the exception of subscriptions, for which alternative payment methods are available.
All transactions are conducted in Euros (EUR). Any currency conversion fees are the responsibility of the Fan.

8.2 Wallet & Payment Methods

Fans must top up their Wallet in order to carry out transactions on the Platform.
The Wallet can be topped up using the payment methods offered by 4secretfans.
Once added, Wallet funds may be used for Pay-Per-View (PPV) content, tips, and other one-time purchases.
Subscriptions are the only exception: they may be paid directly using various payment methods without first topping up the Wallet.

8.3 Subscriptions & Recurring Payments

Subscriptions to Creator profiles automatically renew unless:
- the registered payment method is declined;
- the subscription price has increased;
- the Fan cancels the subscription through the Creator's profile.
After cancellation, access remains available until the end of the current subscription period. Thereafter, no further payments will be collected, and access will end.
Subscriptions are paid using either the Wallet or one of the available payment methods.

Recurring Billing:

When purchasing an automatically renewing subscription, Fans authorize 4secretfans or the payment service provider to charge the registered payment method on the first day of each billing period.

If the registered payment method becomes invalid (for example, an expired credit card) and payment cannot be collected, access to the subscription may be restricted or suspended.

8.4 Pay-Per-View (PPV) Content & Tips

All one-time purchases (PPV, tips, Pay-per-Message, etc.) are paid exclusively through the Wallet.

8.5 Commission & Monetization for Creators

Creators may monetize content and set their own prices for subscriptions, PPV content, and tips.
4secretfans charges a 30% commission on Creators' earnings.
Payouts are made through the available payment methods in compliance with applicable legal requirements.
Creators are solely responsible for reporting and paying taxes on their earnings and must comply with all applicable tax laws.

8.6 Refunds & Chargebacks

Fans agree not to submit fraudulent refund requests or chargebacks through their payment service provider.
If a chargeback is initiated fraudulently, 4secretfans reserves the right to suspend or terminate the account.
To the extent permitted by law, all payments are final and non-refundable.
Refund requests may be reviewed on a case-by-case basis, particularly in cases of duplicate charges, technical errors, or unauthorized transactions.

8.7 Wallet Balance & Refunds

Wallet balances cannot be split across multiple payment sources.
Refunds of unused Wallet balances are only available in accordance with applicable consumer protection laws.
In Germany, 4secretfans complies with the applicable legal requirements for virtual wallets.

8.8 Billing and Subscription Information

By purchasing a subscription, the user agrees to recurring charges until the subscription is cancelled. Subscription fees automatically renew at the end of each billing period unless the subscription is cancelled before the renewal date.

The applicable subscription amount, billing frequency, and renewal date are displayed during the checkout process before payment confirmation.

Users may cancel their subscriptions at any time through their account settings. Cancellation stops future recurring charges but does not entitle the user to a refund of payments already processed unless required by law.

8.9 Trial and Promotional Offers

Any free trial or promotional offer will automatically convert into a paid subscription once the promotional period ends unless cancelled before the trial period expires.

The duration of the trial period and the subscription fee applicable after the trial ends are clearly displayed during the checkout process.

8.9.1 Cancellation Policy

Users may cancel recurring subscriptions at any time through their account settings. The cancellation becomes effective at the end of the current billing period. After cancellation, no further recurring charges will be made. Deleting an account does not automatically cancel active subscriptions.

9. Purchasing Products in the Shop / Marketplace

9.1 Seller Responsibilities

Guidelines for Uploaded Content

All publicly uploaded images, videos, and product presentations must be suitable for a general audience.

FSK18 content may only be offered as paid content (e.g., Pay-Per-View). Publicly available content must not contain depictions of the following body parts or activities:

Genitals (of any gender)
Labia
Penis
Penis tip
Testicles
Vagina
Nipples
Anus
Sexual acts or explicit sexual activities
Masturbation
Penetration or similar sexual acts
Intimate touching or sexual stimulation
Bodily fluids in an explicitly sexual context

Such content may only be labeled as FSK18 content and made available exclusively to paying, verified adult users.

Prohibition of AI-Generated Content

Content must not infringe the rights of third parties and must comply with all applicable legal requirements.
AI-generated images, deepfakes, and manipulated content that deceive or imitate real individuals are prohibited.
Standard image editing (e.g., brightness, contrast, or color adjustments) is permitted, provided that the authenticity of the content is not materially altered.

Usage Rights

Sellers grant 4secretfans the necessary usage rights to provide, store, technically process, and display their content within the platform.

Content Review

4secretfans reviews published content as part of platform moderation and in response to reported violations. Content that violates applicable laws, these Terms of Service, platform policies, or payment provider requirements will be removed or restricted.

Liability

Sellers warrant that their offered products and content do not infringe any third-party rights and that they provide all information required for their offers. Where legitimate third-party claims arise due to a legal violation caused by the seller, the seller will support the platform in clarifying the matter and provide any necessary information.

9.2 Sale and Delivery of Products

Product Listings

Sellers may offer digital and physical products through the Platform, provided that such products comply with applicable laws and these Terms & Conditions.

Shipping and Packaging

Sellers are responsible for properly packaging and shipping their products within the required time. For hygiene reasons, worn underwear must be packaged in an airtight and transport-safe manner.

Legal Requirements

Sellers warrant that all products offered comply with the laws of their own country and, where applicable, the laws of the destination country.

Order Process

Upon completion of an order, both the buyer and the seller will receive a confirmation by email. Payments shall be made exclusively using the payment methods offered by 4secretfans.

Acceptance or Rejection of Orders

An order constitutes a binding offer by the buyer. The seller shall decide whether to accept the order within three business days. If the order is not accepted within this period, it will automatically be cancelled and the amount paid will be refunded. Accepted orders must be shipped within seven business days.

9.3 Customer Service and Liability

If buyers have questions or problems regarding physical products, they may contact Customer Support at support@4secretfans.com.

Responsibility of 4secretfans

4secretfans provides the technical Platform for the sale of products. To the extent that 4secretfans is responsible as the contractual party, intermediary, or Platform operator under applicable law, 4secretfans shall fulfill the legal obligations arising therefrom. Sellers remain responsible for the accuracy of their product descriptions, the performance of the contract, shipping, and compliance with all applicable legal obligations.

Purchase Agreements and User Responsibility

Buyers and sellers are obligated to properly fulfill their respective contractual obligations.

Returns and Exchanges

To the extent permitted by law, returns and exchanges of hygiene products are excluded. Statutory consumer rights and mandatory warranty rights remain unaffected. Buyers should carefully review product descriptions and seller information before placing an order.

10. Guidelines for Permissible Use

10.1 Prohibited Use

You may use 4secretfans only in accordance with these Terms & Conditions and applicable law. Without the prior written consent of 4secretfans, you are specifically prohibited from:

violating applicable laws, data protection regulations, or copyright laws;
downloading content unless an official download function is provided;
failing to comply with court orders or governmental regulations;
using 4secretfans if you are registered as a sex offender or are legally required to be registered as a sex offender;
publishing threatening, abusive, discriminatory, violent, or otherwise unlawful content;
publishing or distributing content containing hate speech or depictions of illegal activities (e.g., violence, child sexual exploitation, or animal cruelty);
extorting, deceiving, or engaging in fraudulent conduct toward other users;
publishing personal data of other persons without their consent or without a legal basis;
impersonating another person or using bots or automated systems to manipulate the Platform;
using artificial intelligence (AI) to create or manage accounts or to publish prohibited content;
using the Platform to arrange or promote escort services, prostitution, or comparable activities;
directing users to external communication channels for the purpose of violating these Terms & Conditions or applicable law;
publishing content or information relating to minors, depicting minors, or otherwise compromising the protection of minors;
contacting minors for the purpose of violating applicable law or these Terms & Conditions;
promoting, supporting, or depicting human trafficking, sex trafficking, coercion, exploitation, abuse, or any other non-consensual acts;
visibly depicting background persons or other unidentified individuals in uploaded content unless valid consent has been obtained from all persons concerned;
publishing content depicting illegal drugs, significant intoxication, or situations in which valid consent may reasonably be questioned;
depicting alcoholic beverages or alcohol-like substances in a manner that violates applicable law, the Platform Policies, or the requirements of payment service providers;
publishing content involving animals where such content violates applicable law, the Platform Policies, or binding requirements of payment service providers.

Suspected violations will be investigated and, where legally required or where there is reasonable suspicion of a criminal offense, reported to the competent authorities.

10.2 Consequences of Violations

Violations of these Terms & Conditions will result in appropriate measures by the Platform depending on the nature and severity of the violation. Such measures may include, in particular, the removal of content, temporary suspension of the account, or termination of the user account.

To the extent permitted by law, earnings resulting from unlawful or fraudulent activities may be withheld until the matter has been finally resolved, or legally required refunds may be issued.

10.3 Additional Obligations for Creators

Creators are required to use the Platform lawfully and in accordance with these Terms & Conditions.

In particular, Creators are prohibited from:

misleading Fans regarding paid content;
engaging in fraudulent activities or fraudulent transactions;
presenting pre-recorded content as live streams;
making false statements regarding content or services offered;
streaming or recording sexual acts in public places where prohibited by applicable law;
publishing personal data of other persons without their consent;
accepting payments for personal meetings involving sexual activities or comparable services;
intentionally defaming or unlawfully harming 4secretfans or other users.

Violations will be sanctioned in accordance with these Terms & Conditions.

10.4 Anti-Human Trafficking Policy

4secretfans prohibits all forms of human trafficking, sexual exploitation, coercion, abuse, and any other non-consensual acts. All reported cases or suspected violations identified through moderation will be investigated. Confirmed violations or sufficiently substantiated suspicions will be reported to the competent law enforcement or regulatory authorities in accordance with applicable law. Accounts used for human trafficking, exploitation, or comparable serious violations will be suspended or terminated immediately.

10.5 Reporting Violations

If you become aware of unlawful content or violations of these Terms & Conditions, please report them by email to support@4secretfans.com, including all available information.

11.2 Creator Content & Deletion Options

Subscription Content:
After account deletion, subscribed content will no longer be accessible to fans. Existing subscriptions will also be deleted and will not continue.

11.3 Refunds & Chargebacks

If a fan successfully initiates a chargeback through their payment provider, 4secretfans will review the case. If necessary, the corresponding amount may be deducted from your account.
