"Buyer" refers to all users, whether Creator or Fan.

"4secretfans" refers to the social network of users operated on the website, enabling users to provide and view content where applicable.
"Payment Provider" refers to a third-party provider approved by 4secretfans that enables a user to make payments or a Creator to receive payments.
"User Account" refers to the section of the website that is accessible only by 4secretfans or the respective user and contains the user’s payment information.
"User Content" refers to all photos, videos, and other materials or facilities uploaded by a Creator to the website.
"Website" refers to the website at www.4secretfans.com.
"The Provider" refers to the website www.4secretfans.com.

Acceptance of these terms

This document, our rules, policies, and the other documents referred to herein together form our Terms and Conditions ("Terms"). This agreement sets forth your rights and obligations that you must comply with when registering and using 4secretfans. If you do not agree to these Terms or fail to comply with them, you may not access or use 4secretfans. We may modify these Terms from time to time. You can view the latest modification at the top of the page. Pre-existing disputes are not affected by these modifications if they arose before the publication of the changes. 4secretfans will attempt to inform you of changes to these Terms but is under no obligation to do so. By continuing to use 4secretfans after changes to the Terms, you agree to the modified agreement. The determination of what constitutes a significant change is at the reasonable discretion and judgment of 4secretfans. By continuing to use the 4secretfans platform and accepting payments, the Creator and/or User acknowledge their understanding and agreement to these Terms.

BY USING OUR SERVICE, YOU ENTER INTO A LEGALLY BINDING AGREEMENT TO COMPLY WITH THESE TERMS.

2. License

2.1 Grant of License:

4secretfans hereby grants you a non-exclusive, non-transferable, non-sublicensable license to access the website and its content for your personal and non-commercial use, in accordance with this agreement. The license granted under Section 2.1 does not include the following:

Resale or commercial use of the website;

Use of data scraping, bots, or similar data collection or extraction methods;

3. Intellectual Property Rights of 4secretfans

3.1 Ownership of the Website:

Unless otherwise stated in this agreement or on the website, 4secretfans owns or has a license to use:

The website, including its past, present, and future versions;
All web pages within the website;
All materials and information on the website;
All graphics, text, images, audio files, videos, designs, compilations, advertisements, articles, user interfaces, illustrations, software applications, copyrighted content (including source and object code), and all other materials, including the design, structure, "look and feel," and arrangement of content on the website;
All trade names, trademarks, service marks, logos, domain names, and other distinctive brand elements, whether registered or not, included on the website.

Intellectual property rights, including copyrights, patents, service marks, trademarks, trade dress, trade secrets, international agreements, and various other laws protecting intellectual property and preventing unfair competition, protect the website and its content. When using the website or its content, all applicable intellectual property rights and specific notices on the website must be observed.

To register an account as a fan on 4secretfans, you must provide a valid email address, username, and password. If you wish to purchase content or subscribe to creators, a valid payment method is required. 4secretfans does not store payment information.

4.2 Creators:

You must complete the registration process by providing 4secretfans with accurate information. Your registration is subject to review and approval at the company’s sole discretion. If you wish to sell content on 4secretfans, you must verify your legal age (at least 18 years old) by providing official identification and linking a verified bank account or one of the available payout options.

Additionally, as a creator on 4secretfans, you confirm that you hold the necessary work rights in your country of residence. This includes valid work permits or visas, if applicable. You are responsible for ensuring that you have the legal authorizations required to use 4secretfans, including compliance with tax regulations and obtaining tax identification numbers.

4secretfans reserves the right to verify your compliance with these requirements at any time and may request additional documents or information to confirm your eligibility to use the platform as a creator. Failure to meet these requirements may result in the suspension or termination of your account without prior notice.

By continuing to use 4secretfans as a creator, you confirm that you have read, understood, and accepted these terms regarding registration, verification, and compliance with work and legal regulations.

4.3 User Confirmations:

By registering and creating an account on 4secretfans, you confirm and guarantee that:

All registration and profile information, as well as the content you provide, belong to you and are complete, truthful, and accurate;
You are responsible for maintaining the confidentiality of your password and account;
You take special precautions when accessing your account from a public or shared computer to prevent unauthorized access to your account and personal data;
You are responsible for all activities that occur under your account;
You will immediately notify 4secretfans of any unauthorized use of your account or security breaches;
You will never use another person's account;
Your previous account on 4secretfans has not been suspended or terminated for violating this agreement;
You are creating your account for your own personal use and will not sell, rent, or transfer it to any third party;
You have the right to grant the licenses set forth in these terms and, if using 4secretfans on behalf of a company or other legal entity, you are authorized to bind them to these terms.

4.4 Liability for Account Misuse:

4secretfans is not liable for any losses you may incur due to third parties using your account or password, whether with or without your knowledge. However, you may be held responsible for losses incurred by 4secretfans or others due to unauthorized use of your account or password.

4.5 Account Security:

4secretfans values the integrity and security of your personal data. However, it cannot guarantee that unauthorized third parties will never be able to bypass the website’s security measures or use your personal data for unlawful purposes. You acknowledge that you provide your personal information at your own risk.

To further enhance the security of your account, the platform offers two-factor authentication, which you can activate in the settings at any time.

5. Content Review and Verification Policies

Pre-Review of Uploaded Content

All content uploaded by users must be reviewed before publication to ensure compliance with applicable laws and platform standards.
The review process includes:
- Automated checks for problematic content
- Manual review by moderators
- Requesting additional proof if necessary (e.g., age verification)

Content that does not meet these standards will be removed or not approved. The platform reserves the right to block inappropriate content and take further action against the uploader if necessary.

Identity and Age Verification

Content creators must undergo an ID verification process to confirm their identity and ensure they are of legal age.
Regular users (fans) must complete an age verification process to confirm they are at least 18 years old.
Content creators may only upload content in which they themselves appear. If other individuals are featured in the content, creators must:
- Verify the identity and age of all individuals depicted to ensure they are of legal age.
- Keep proof of these verifications and provide them upon request from the platform.

6. User Conduct Rules

Users are prohibited from engaging in the following activities:

Copying, distributing, or disclosing parts of the website in any media, including through automated or non-automated "scraping."
Using automated systems such as "robots," "spiders," or "offline readers" to access the website.
Sending spam, chain letters, or other unsolicited emails.
Attempting to disrupt or compromise the system integrity or security, or decrypting transmissions to or from the website’s servers.

7. User Rights and Responsibilities

7.1 Copyright and Usage Rights

Creators retain all rights to their uploaded content. By uploading content, they grant 4secretfans a non-exclusive, transferable, sublicensable, and royalty-free worldwide license to make the content available and display it on the platform.
Use of content outside the platform (including modification, distribution, or public performance) requires the explicit consent of the creator.
This license is solely intended to ensure the functionality of the platform and to provide content to users.

7.2 Responsibility for Uploaded Content

Each user is solely responsible for the content they publish and confirms upon uploading that:

They have all necessary rights, licenses, and permissions for publication.
No third-party rights are violated.
The content complies with platform policies and applicable laws.

4secretfans reserves the right to review, block, or remove content that violates these terms.

7.3 Use and Protection of Creator and Fan Content

Creators guarantee that they own all necessary rights to the uploaded content.
Fans may not reproduce or redistribute purchased content.

7.4 Comments & User-Generated Content

Users may post comments and opinions in certain areas of the platform. The following rules apply:

4secretfans does not pre-moderate comments but reserves the right to remove inappropriate or offensive content.
Users may not post content or comments that:
- Violate third-party rights.
- Are offensive, defamatory, or libelous.
- Are used for commercial purposes or illegal activities.

8. Payment Terms & Monetization

8.1 General Provisions for Transactions

All financial transactions on 4secretfans take place between fans and the platform 4secretfans.
4secretfans facilitates payments, stores content, and acts as a contractual party in these transactions.
Creators provide content at their own discretion—4secretfans has no influence over the type, quantity, or quality of the content provided.
Creators set their own prices. It is the user's responsibility to check the price before subscribing or making a purchase.
All payments are made through the wallet, except for subscriptions, which offer alternative payment methods.
Transactions are conducted in Euros (EUR). Any currency conversion fees are borne by the fan.

8.2 Wallet & Payment Methods

Fans must top up their wallet to carry out transactions on the platform.
The wallet can be funded using the payment methods offered by 4secretfans.
Once loaded, wallet funds can be used for Pay-Per-View (PPV) content, tips, and other one-time purchases.
Subscriptions are the only exception: These can be paid directly using various payment methods without prior wallet funding.

8.3 Subscriptions & Recurring Payments

Subscriptions for creator profiles are automatically renewed unless:
- The registered payment method is declined.
- The subscription price has increased.
- The fan cancels the subscription in the creator's profile.
After cancellation, access remains until the end of the current subscription period. No further payments will be deducted, and access will end.
Subscriptions can be paid using the wallet or any of the available payment methods.

Recurring Billing:

By purchasing an automatically renewing subscription, fans authorize 4secretfans or the payment service provider to charge the registered payment method on the first day of each billing period.
If the registered payment method becomes invalid (e.g., expired credit card) and payment cannot be processed, access to the subscription may be restricted or suspended.

8.4 Pay-Per-View (PPV) Content & Tips

All one-time purchases (PPV, tips, pay-per-message, etc.) are paid exclusively through the wallet.

8.5 Commission & Monetization for Creators

Creators can monetize content and set individual prices for subscriptions, PPV, and tips.
4secretfans charges a 30% commission on creator earnings.
Payouts are processed through the available payment methods in compliance with legal requirements.
Creators are responsible for declaring their earnings and complying with all tax regulations.

8.6 Refunds & Chargebacks

Tips are final and non-refundable.
Fans agree not to make fraudulent refund requests or chargebacks through their payment provider.
If a chargeback is fraudulently made, 4secretfans reserves the right to suspend or delete the account.

8.7 Wallet Balance & Refunds

Wallet balance cannot be split across multiple payment sources.
Refunds of unused wallet balances are only possible in accordance with applicable consumer protection laws.
In Germany, 4secretfans adheres to legal regulations for virtual wallets.

9. Purchasing Products in the Shop / Marketplace

9.1 Seller Responsibilities

Guidelines for Uploaded Content

All publicly uploaded images, videos, and products must be suitable for a general audience.
Adult-rated (FSK18) content may only be uploaded if it is paywalled (e.g., through a Pay-Per-View system).
The following body parts may not be displayed unless the content is behind a paywall:
- Genitals (both sexes)
- Labia (women)
- Penis (men)
- Nipples (especially women)
- Anus (both sexes)
- Sexual acts or explicit depictions of sexual activities
- Vagina (women)
- Testicles (men)
- Penis tip (men)

Basic image editing (e.g., brightness or contrast adjustments) is allowed only if it does not alter the authenticity of the photo.

Usage Rights

Sellers grant 4secretfans the rights to use and display their content on the platform.

Content Control

Sellers are responsible for the accuracy and legal compliance of their content.
4secretfans may remove content that violates these rules.

Liability

Sellers bear full responsibility for their products and content.
They indemnify 4secretfans against any third-party claims in the event of legal violations.

9.2 Selling & Delivering Products

Product Listings:

Sellers can offer digital and physical products on the platform.

Shipping & Packaging:

Sellers are responsible for secure packaging and timely delivery.
Used underwear must be vacuum-sealed to prevent hygiene and health risks.

Legal Compliance:

Sellers must ensure that their products comply with the laws of both their country and the buyer's country.

Ordering Process:

Once a purchase is completed, both the buyer and seller receive a notification via email.
This email may sometimes end up in the spam folder, so users should check their spam folder if they do not see it in their inbox.
Payments are processed using the available payment methods.

Accepting or Rejecting Orders:

A buyer's order is considered a binding offer. The seller can either accept or decline it.
If an order is not accepted within three business days, an automatic refund is issued.
Accepted orders must be shipped within seven business days.

10. Guidelines for Permissible Use

10.1 Prohibited Use

You may only use 4secretfans in accordance with the Terms of Use. Without our prior written consent, the following is prohibited:

Violating applicable laws, data protection regulations, or copyright laws.

Ignoring court orders or government regulations.
Using 4secretfans if you are registered as a sex offender or are required to be.

Creators must always act in the best interest of 4secretfans. A violation may result in account suspension or deletion. In particular, the following is prohibited:

Deceiving fans regarding paid content.
Engaging in fraud or fraudulent transactions.
Presenting pre-recorded content as live streams.
Providing false information about content or services.
Streaming sexual acts in public areas.
Publishing private information of others without their consent.
Accepting payments for meetings with sexual intentions.
Damaging the reputation of 4secretfans or its users.

10.4 Reporting Violations

If you notice suspicious content or rule violations, please report them via email to support@4secretfans.com with all relevant details.

11. Account Deletion & Refund Policies

11.1 Account Deletion

As a fan or creator, you can request the deletion of your account at any time. Once your request is received, 4secretfans will initiate the deletion process, which will be completed within 10 days at the latest. This period allows for the settlement of outstanding transactions and compliance with legal retention obligations.

In exceptional cases, such as multiple short-term deactivations and reactivations, the deletion process may take up to six months. In such cases, you will be informed accordingly. Our goal is to complete deletions within the standard 90-day period.

11.2 Creator Content & Deletion Options

Subscription Content:
After account deletion, subscribed content will no longer be accessible to fans. Existing subscriptions will also be deleted and will not continue.

11.3 Refunds & Chargebacks

If a fan successfully initiates a chargeback through their payment provider, 4secretfans will review the case. If necessary, the corresponding amount may be deducted from your account.
